1. GENERAL INFORMATION

The website www.kaaboeurope.com is owned by THETATAU CORP, S.L., with Tax ID (CIF) B72515109, hereinafter referred to as KAABO Europe.

These General Conditions of Sale (“GCS”) shall be deemed fully accepted by Customers by the mere act of placing an order, making a purchase request, or accepting an offer.

Any other general conditions different from those set forth herein, including those that may be provided by the Customer, are expressly excluded from application to the contractual relationship between KAABO Europe and the Customer, even if KAABO Europe is aware of them, unless expressly accepted in writing by KAABO Europe.

The sales contract for a product purchased through the website consists of these General Conditions of Sale in force at the time of the order and the corresponding purchase order. Customers are invited to read them carefully before confirming any order.

By placing an order, the Customer declares that they have full legal capacity to enter into a binding contract and accept these General Conditions of Sale.


2. WEBSITE CONTENT

KAABO Europe makes every reasonable effort to ensure that the descriptions, drawings, and information contained on the website and in catalogs are accurate. However, unless expressly agreed otherwise, such information is provided for informational purposes only and shall not be considered binding.

KAABO Europe shall not be liable for any inaccuracies that may exist in product descriptions or website content.

The essential characteristics of the products and services offered for sale are described on the website. Photographs, texts, and technical data sheets (provided by manufacturers and suppliers) are the property of KAABO Europe.


3. VALIDITY OF SALES OFFERS

Product and price offers are available for defined periods.

For products not available in stock, estimated delivery times are indicated on the product pages. All offers are subject to supplier availability.

If a product is unavailable, the Customer will be informed as soon as possible via their customer account and/or email. If the delivery timeframe is not acceptable, the Customer may modify or cancel the order by contacting customer service.


4. PRODUCT PRICES

Prices applicable are those in force at the time the order is accepted. Prices may be modified at any time without prior notice.

All product prices displayed on KAABO Europe do not include shipping costs, unless otherwise stated.

Unless expressly agreed otherwise, all prices are final, displayed in Euros (€), and include VAT, applied in accordance with the Customer’s location and applicable law.

If applicable tariffs increase during order processing, KAABO Europe reserves the right to adjust prices accordingly, after prior notification to the Customer by email.

For transactions carried out in currencies other than Euros, any exchange rate variation, shipping costs, and additional charges shall be borne by the Customer.

KAABO Europe reserves the right to apply additional charges for orders below the minimum order value or for orders not meeting minimum quantity requirements.


5. ORDERS

5.1 Order Placement

To place an order, the Customer must identify themselves by completing the online form with accurate information, including full name, phone number, postal address, email address, billing address, and shipping address.

The order is confirmed by clicking the “Confirm Order” button, indicating full acceptance of these General Conditions of Sale. Once confirmed, a purchase order number will be issued and communicated via on-screen confirmation and/or email.

Records maintained by KAABO Europe constitute proof of the transaction, its content, and its date.


5.2 Order Management

To modify or manage an order after confirmation, Customers must contact customer service via the contact details provided on the website.

Orders for special, reserved, or discontinued products cannot be modified or canceled. If cancellation is exceptionally accepted, a minimum cancellation fee of 10% of the total order value (VAT included) will apply.

Invoices will detail unit prices excluding VAT, VAT amounts, and the total price including VAT.


6. PAYMENT METHODS

All purchases on KAABO Europe support credit cards and multiple payment methods.

All online payment technologies are provided by Stripe. After order confirmation, Customers are redirected to Stripe’s secure payment platform.

KAABO Europe does not access or store payment card information. All payment data is processed securely by Stripe in accordance with applicable regulations.

Pre-orders / Reservations

For reservation orders, the order becomes valid after payment of 30% of the total order price. Once the product arrives, the Customer will be notified to complete payment of the remaining 70%.

If full payment is not completed within 24 hours after notification, the order will be automatically canceled.


7. DELIVERY OF GOODS

7.1 Delivery Process

After payment confirmation, KAABO Europe will prepare the order within 48 hours, subject to stock availability.

Once shipped, Customers will receive a tracking email.

Delivery addresses cannot be modified once the goods have left the warehouse.

Shipments are handled by third-party carriers (e.g., Correos, UPS, MRW, DHL, GLS), depending on destination and product characteristics.


7.2 Delivery Time

Delivery times vary depending on the carrier and destination. Customers are encouraged to inquire before placing an order.

For reserved products, delivery will begin after the final payment has been completed.

Any delivery delays will be communicated to the Customer in advance.


7.3 Transfer of Risk

The risk of loss or damage to goods transfers to the Customer upon delivery or when the goods are made available.

If delivery is delayed due to the Customer, risk transfers at the time delivery should have occurred.


7.4 Claims Regarding Goods

Any claims regarding packaging condition or quantity must be noted immediately upon delivery on the delivery receipt.

Claims regarding defects, identification errors, or visible damage must be submitted in writing within 10 business days of delivery, referencing the delivery note number.

Failure to notify within this period constitutes acceptance of the goods, without prejudice to latent defect claims.


8. AFTER-SALES SERVICE

8.1 Warranty Policy

All electrical products sold by KAABO Europe include a 3-year warranty, except non-flooded batteries, which have a 6-month warranty.

The warranty does not cover damage caused by:

  • Improper use or failure to follow instructions
  • Water damage or immersion
  • Overloading beyond rated power
  • Use of non-approved accessories
  • Drops, impacts, misuse, or human-related damage

Shipping costs are covered only for products under warranty. Otherwise, testing and shipping costs may apply.

8.2 Cancellation Policy

Customers may request a full refund within 24 hours of placing an order.

Refunds requested after 24 hours and before shipment may incur a transaction fee.

Orders cannot be canceled once shipment notification has been issued.


8.3 Return Policy

Customers may return products within 14 days of receipt, provided items are unused, complete, and in original packaging.

Return shipping costs and transaction fees are borne by the Customer.

After 14 days, returns or exchanges are not accepted.

In case of quality issues, a full refund or replacement will be provided within 30 days of receipt.


8.4 Refunds

Refunds will be issued within 14 business days after the returned product is received.

Customers will be notified by email once the refund has been processed.


9. LIABILITY

9.1 Disclaimer of Warranties

Products are provided “as is” and “as available”, except as expressly stated in the warranty policy.

KAABO Europe disclaims all implied warranties to the fullest extent permitted by law, including merchantability and fitness for a particular purpose, except where legally prohibited.


9.2 Limitation of Liability

To the maximum extent permitted by law, THETATAU CORP, S.L. shall not be liable for indirect, incidental, consequential, or punitive damages.

Nothing in these terms limits liability for fraud, willful misconduct, personal injury, or death resulting from negligence, or any liability that cannot be excluded by law.


10. APPLICABLE LAW AND JURISDICTION

These General Conditions of Sale are governed by Spanish law.

Any disputes shall be submitted to the Courts and Tribunals of Barcelona, Spain, without prejudice to mandatory consumer protection laws.
